Terms of Use

Translation. This is an English translation for convenience. If it differs from the Ukrainian version, the Ukrainian version prevails.

These Terms are an agreement between you and IT Zeyz, [ЄДРПОУ / РНОКПП] (“we”) on the use of the QMaply app and the website qmaply.com (together, the “Service”). They are an electronic contract under the Law of Ukraine “On Electronic Commerce”.

How the agreement is made. The agreement is concluded when you tick “I agree to the Terms of Use and the Privacy Policy” during registration. If you use the Service without an account, you accept these Terms by using it. If you do not agree, do not use the Service.

1. The Service

QMaply is an interactive map of the residential complexes connected to the Service. Residents find businesses and services in their complex, and business owners publish and update information about their places.

2. Price

The Service is currently free for residents and businesses. We may introduce paid features for businesses in the future. They will be optional, and we will publish their terms before launch. Existing free features will not become paid without your consent.

3. Account

  • You can view the map without an account. An account is needed to add or edit a business, save favourite places, and send reports.
  • You must be at least 16 to create an account.
  • You provide accurate data and are responsible for keeping access to your account secure.
  • You can delete your account at any time in the App or by following these instructions.

4. Listing a business

  • Only the owner or an authorised representative of a business that actually operates in a complex connected to the Service may add it.
  • You confirm that the business information (name, location in the complex, hours, contacts, photos) is true and does not infringe third-party rights, and that the business operates lawfully, including holding any required licences.
  • Every submission and change is moderated. We may ask for documents confirming your authority or licence, and may reject, edit or unpublish a card that breaks these Terms or the Content Rules.
  • You agree to update the information if the hours change or the business moves or closes.

5. Business offers

Businesses may publish offers and discounts for residents. The business that publishes an offer sets and fulfils its terms. We are not a party to your dealings with a business and are not responsible for offers or for the quality of a business’s goods and services.

6. Your content

You keep the rights to the content you upload (text, photos). By publishing it, you give us a free, non-exclusive, worldwide licence to use, reproduce and display it within the Service for as long as it is published. The licence ends when the content is deleted, unless the law requires us to keep it.

7. Not allowed

  • posting false, offensive or unlawful information, or spam;
  • impersonating other people or businesses;
  • interfering with the Service, bypassing its protection, or scraping data;
  • using the Service in breach of Ukrainian law.

8. Information on the map

We check data before publishing it, but business owners provide the information about their businesses. We do not guarantee it is fully accurate. If you spot a mistake, tap “Report a mistake” on the business card or write to support@qmaply.com.

9. Intellectual property

The App, its design, the complex maps, the logo and the QMaply name belong to us or our licensors. We give you a limited, non-exclusive, non-transferable licence to use the App for its intended purpose, including listing and managing business cards.

10. Liability

The Service is provided “as is”. To the extent permitted by law, we are not liable for indirect losses or loss of data or profit related to using the Service. This does not limit your rights under Ukrainian law, including the Law of Ukraine “On Consumer Rights Protection”.

11. Suspension and termination

We may restrict or end access to an account that breaks these Terms and will tell you why, unless the law forbids it. You may end the agreement at any time by deleting your account.

12. App store terms

If you downloaded the App from the App Store, these Terms are between you and us, not Apple Inc. Apple is not responsible for the App or its support. Apple’s standard Licensed Application End User License Agreement (EULA) also applies. Apple and its subsidiaries are third-party beneficiaries of these Terms. If you downloaded the App from Google Play, the Google Play Terms of Service also apply.

13. Governing law and disputes

These Terms are governed by the law of Ukraine. Disputes are settled by negotiation and, failing agreement, by a court under Ukrainian law. You can send a claim to support@qmaply.com; we reply within 14 days.

14. Changes to these Terms

We may change these Terms. We will announce material changes in the App and by email at least 14 days before they take effect. If you do not agree, you can delete your account. Continuing to use the Service after the changes take effect means you accept them.
